Fulfilment Policy

At Hit Happens / Corey Lee Barker, we ensure that the services we provide are satisfactory. Customer satisfaction is our utmost priority.

Our Fulfillment Policy is designed to ensure a smooth and efficient process for our customers. We strive to process and ship all orders within a specified timeframe, keeping you informed every step of the way. you have any questions concerns regarding your order, please don't hesitate to reach out our customer service team. Your satisfaction is our top priority!

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person on this website and compliant to the Company’s terms and conditions, either therein or in a separate written contract. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing laws of the State of Tennessee. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same. 

Delivery Policy 

At Hit Happens / Corey Lee Barker, we sell consulting and songwriting services. We deliver our services to clients via electronic and telephonic means pursuant to our client’s requests. For physical products, we outsource through an outside agency for warehousing and fulfillment.  Product fulfillment will only become available when Products are stocked in inventory. Stocking Products can take some additional time, especially when the Products don’t comply with our labeling requirements.

Indemnity


You will indemnify and hold Hit Happens / Corey Lee Barker (and its officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

Law and Jurisdiction


If a dispute arises between you and Hit Happens / Corey Lee Barker, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

Any dispute or claim arising out of or in connection with Services or subject matter or formation (including non-contractual disputes or claims) must be resolved by a court located in the State of Tennessee, USA.

General


No agency, partnership, joint venture, employee-employer, franchisor-franchisee relationship, etc. is intended or created by this Agreement. You acknowledge that you have all the necessary permits to grant us with Customers’ personal data to fulfill this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In our sole discretion, we may assign this Agreement upon notice to you. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee that we will take action against all breaches of this Agreement.​​​

Exceptions ​

Notwithstanding other provisions of this Policy, we may refuse to grant returns or refunds if: 

  • You received what you ordered, but simply changed your mind about the service.

  • You were aware or notified of the problems with the service before making the purchase.

  • You did not like your purchase, did not understand, clarify your needs, or realized you had no use of it.

  • You received the service/product and failed to make a report within 7 days from the date of receipt.

  • You hereby agree that any returned orders due to the wrong shipping address or a failure to claim the shipment won’t be available for reshipping and will be donated to charity at your cost (without us issuing a refund).

Services - Return Policy 

At Hit Happens / Corey Lee Barker, we sell consulting and songwriting services. No returns can be made but in some circumstances we offer refunds. 

For Services, we may offer refunds in the following conditions: 

  • If the service has not been performed at all during the term of our contract.​

 

Refunds -  Physical Goods

  • Claims deemed an error on our part are covered at our expense.

  • If you an issue on the products or anything else on the order, please submit a problem report using the Contact Form. Be aware we may require a photo to be submitted with your problem report to begin a reshipment. 

  • We do not offer size exchanges or returns/refunds for buyer's remorse. 

  • Any claims for misprinted/damaged/defective items must be submitted within 7 days after the product has been received. For packages lost in transit, all claims must be submitted no later than 7 days after the estimated delivery date. Claims deemed an error on our part are covered at our expense.

  • If you notice an issue on the products or anything else on the order, please submit a problem report.

  • The return address is set by default to the Printing facility. When we receive a returned shipment, an automated email notification will be sent. 

  • Wrong Address - If you or your end customer provide an address that is considered insufficient by the courier, the shipment will be returned to our facility. You will be liable for reshipment costs once we have confirmed an updated address with you (if and as applicable).

  • Unclaimed - Shipments that go unclaimed are returned to our facility and you will be liable for the cost of a reshipment to yourself (if and as applicable).

Cancellation Policy 

Your appointments and well-being are very important to us. We understand that sometimes, unexpected delays can occur, making schedule adjustments. If you need to cancel your appointment, we respectfully request at least 24-hour notice.

Our Policy:

Any cancellation or reschedule made less than 24-hours will result in a cancellation fee. Cancellations made 24-hours or more in advance of the Appointment/Service/Event date will receive a 100% refund. Cancellations made less than 24 hours will not receive a refund. If you are more than 30 minutes late for your service, we may not be able to accommodate you. In this case, the same cancellation fee may apply. We will do our very best to reschedule your service for another time that is convenient to you. We require a credit card to hold your appointment. Cancellation fees will be charged to your card on file. In the event of a true, unavoidable emergency, all or part of your cancellation fee may be applied to future services.

Project Abandonment 

If after repeated attempts by Hit Happens / Corey Lee Barker to begin service, continue service, or finalize the delivery of the Services, Client fails to participate, or becomes otherwise unresponsive to Hit Happens / Corey Lee Barker’s requests and such continues for a period of thirty (30) days, the project will, at the option of Hit Happens / Corey Lee Barker, be abandoned, whereupon Hit Happens / Corey Lee Barker may reduce any refund for the Services to the Client to zero, and Client hereby provides its agreement to such forfeiture of any amounts of the Fees that have been paid by the Client for the Services as purchased or as described in the original Booking, wherever applicable.

How to make a complaint 

If you are dissatisfied with the service provided to you and you are eligible for a refund under this Policy, you must send an email to corey@coreyleebarker.com stating your complaints and we will immediately verify your complaints. Refunds are issued at our discretion as they may be accepted or rejected.
